Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “you”) and Vaibhav Studios (“we”, “us”, “the Studio”) in accordance with the provisions of the Indian Contract Act, 1872 and the Information Technology Act, 2000.

By accessing, browsing, or purchasing from this Store, you signify your unconditional acceptance of these Terms. If you do not agree with any provision herein, you must immediately discontinue use of this Store.

These Terms are to be read in conjunction with our Privacy Policy, Cookie Policy, Return Policy, Shipping Policy, and all other policies published on this Store, which are expressly incorporated herein by reference.

 

Eligibility to Transact

  • You must be at least 18 (eighteen) years of age to independently enter into a contract for purchase on this Store, in accordance with Section 11 of the Indian Contract Act, 1872.
  • Persons below the age of 18 may use this Store and make purchases only under the supervision of a parent or legal guardian, who shall be deemed to have accepted these Terms on behalf of the minor.
  • By proceeding to purchase, you represent and warrant that you are legally competent to enter into a binding contract under the laws of India.
  • Purchases by corporations or entities must be made by an authorised representative.

About Vaibhav Studios and the Store

Vaibhav Studios is India’s only Emmy-nominated animation studio, based in Mumbai, Maharashtra. The Studio is the creator of Return of the Jungle (directed by Vaibhav Kumaresh). This Store has been established to retail official, authentic merchandise of the animated feature film Return of the Jungle, releasing nationwide in Indian cinemas on 29 May 2026.

All products sold on this Store are official, Vaibhav Studios-authorised merchandise. The sale of any item bearing the name, characters, artwork, or intellectual property of Return of the Jungle through any other channel is unauthorised and may constitute infringement of Vaibhav Studios’ intellectual property rights.

Products and Descriptions

  • We endeavour to display our merchandise as accurately as possible, including product images, descriptions, sizes, and specifications.
  • Colours of products may slightly vary from on-screen representations due to differences in monitor display settings, photography lighting, and printing processes. Such variation does not constitute a defect.
  • Product availability is subject to stock levels. We reserve the right to limit quantities purchased.
  • In the event a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel any orders placed at the incorrect price and notify affected customers.
  • We reserve the right to discontinue any product at any time without notice.

Pricing and GST

  • All prices displayed on the Store are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless expressly stated otherwise.
  • Shipping charges, if any, are additional and will be displayed at checkout before you confirm your order.
  • For international orders, customs duties, import taxes, and any applicable local levies are the sole responsibility of the buyer.
  • Vaibhav Studios reserves the right to modify prices at any time. Price changes will not affect orders already confirmed and paid for.

Order Process and Contract Formation

The contract of sale between you and Vaibhav Studios is formed in the following stages:

  • You browse the Store and add items to your cart.
  • You proceed to checkout and enter your shipping and payment details.
  • You review and confirm your order — this constitutes an “offer” to purchase.
  • A binding contract is formed ONLY upon our issuance of an Order Confirmation email acknowledging acceptance of your order. A mere “order received” notification does not constitute acceptance.
  • If we are unable to fulfil your order for any reason (including stock unavailability), we will notify you and issue a full refund.

User Conduct and Prohibited Activities

In using this Store, you agree that you shall NOT:

  • Misrepresent your identity or impersonate any person or entity
  • Use the Store for any fraudulent, unlawful, or harmful purpose
  • Reproduce, copy, distribute, sell, resell, or exploit any content, product images, or intellectual property from this Store without prior written authorisation from Vaibhav Studios
  • Attempt to reverse-engineer, decompile, or tamper with the Store’s software or security features
  • Use automated scripts, bots, crawlers, or scraping tools on the Store
  • Post or transmit any defamatory, obscene, abusive, or offensive content through Store communication channels
  • Circumvent any geo-restrictions, access controls, or platform terms
  • Engage in any activity that disrupts or interferes with the Store’s servers or networks

Intellectual Property Rights

All content on this Store — including but not limited to the name “Return of the Jungle”, character names (including but not limited to Mihir, Thatha, Rahul Malhotra), film artwork, poster designs, character designs, logos, the “Vaibhav Studios” name and brand, and all merchandise designs — are the exclusive intellectual property of Vaibhav Studios, protected under the Copyright Act, 1957 and the Trade Marks Act, 1999 of India.

No license to use, reproduce, or exploit this intellectual property is granted to users. Unauthorised use constitutes infringement and may attract civil and criminal liability under applicable laws.

Limitation of Liability

To the maximum extent permitted by applicable law:

  1. Vaibhav Studios’ total liability to you for any claim arising out of or related to your use of the Store or any purchase shall not exceed the value of the order in respect of which the claim arises.
  2. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption.
  3. We shall not be liable for any delays, non-delivery, or failure to perform caused by circumstances beyond our reasonable control (Force Majeure), including natural disasters, strikes, civil unrest, governmental orders, or failures of third-party logistics or payment providers.

Indemnification

You agree to indemnify, defend, and hold harmless Vaibhav Studios, its directors, officers, employees, and agents from and against any claims, liabilities, damages, penalties, fines, costs, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your use or misuse of the Store; (c) your infringement of any intellectual property, privacy, or other rights of any third party; or (d) any content you submit through the Store.

Third-Party Links

The Store may contain links to third-party websites for convenience. These links do not constitute an endorsement or approval of those websites by Vaibhav Studios.

We have no control over and accept no responsibility for the content, privacy practices, or availability of third-party websites. Your access to and use of such websites is entirely at your own risk.

Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
  • All disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
  • Before initiating formal legal proceedings, parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 (thirty) days from the date of written notice of the dispute.
  • Users retain all statutory rights under the Consumer Protection Act, 2019 to approach appropriate Consumer Dispute Redressal Commissions.
  • These Terms are drafted in the English language. In the event of any inconsistency between an English version and any translated version, the English version shall prevail.

Modifications to Terms

Vaibhav Studios reserves the right to modify these Terms at any time. We will provide reasonable notice of material changes by posting a notice on the Store or via email.

Your continued use of the Store following the effective date of any change constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
